evidence wise who knows he's in a HEAVILY facist country could have hired someone or someone else could have - maybe he's in danger too
law wise? he's disabled. but he benefitted from the crime so can't claim it be tossed out based on illness and sympathy.
the original law for insanity in court was from england coming at the same time as the creation of publicly taxed and run homes for the permanently mentally ill.
they didn't get off on any crime unless
(a) they didn't profit from it or
(b) it is obvious to everyone in the courtroom incl. the judge (who doesn't care) that the illness was so profound it would not allow the person to follow any laws to begin with
however, morality was still the question. if a person could morally know they should not benefit from a bad act, ill or not, they were convicted
